A registered trademark lasts ten years and must be renewed to stay protected. Expertvuw’s team tracks your renewal dates, files Form TM-R through registered trademark agents, and handles late renewal or restoration if the deadline has passed.
Under the Trade Marks Act, 1999, a registered trademark is valid for ten years and can be renewed for further periods of ten years, indefinitely. Renewal is filed in Form TM-R, and the application can be made up to one year before expiry. The official fee is ₹9,000 per class.
If the renewal is missed, the mark can still be renewed within six months after expiry by paying a surcharge. Between six months and one year after expiry, the registered proprietor can apply to restore and renew the mark, which is at the Registrar’s discretion. After that, the mark is removed from the register and a fresh application may be the only option — with the risk that someone else files first.
Renewal is also a good moment to check that the owner’s name, address and goods/services on the register are still correct.
