Indian businesses can protect their brand in many countries through a single Madrid Protocol application filed via IP India. Expertvuw’s team checks your base mark, selects countries and prepares the MM2 filing, and coordinates with local agents where countries raise objections.
The Madrid Protocol, administered by WIPO, lets a trademark owner seek protection in multiple member countries through one international application, in one language, with one set of fees. India joined in 2013, and Indian applicants file through IP India, which acts as the office of origin.
An international application (Form MM2) must be based on an Indian trademark application or registration — the “base mark”. IP India charges a handling fee (₹5,000, e-filing), and WIPO fees are payable in Swiss francs — a basic fee plus a fee for each designated country. Each designated country examines the mark under its own law and can refuse protection, in which case a local agent is usually needed to respond.
For the first five years, the international registration depends on the base mark: if the Indian mark is refused or cancelled, the international registration falls with it. Countries not in the Madrid system require direct national filings.
Basis: Madrid Agreement and Protocol (WIPO); Trade Marks Act, 1999 (Chapter IVA); Trade Marks Rules, 2017; IP India and WIPO fee schedules. Last updated: 27 September 2026.
