Trademark Monitoring – Watching the Trade Marks Journal for Conflicting Marks

Last updated: 2 October 2026

The window to oppose a conflicting trademark is only four months from its advertisement. Expertvuw’s team monitors the weekly Trade Marks Journal and new filings for marks similar to yours, and alerts you in time to act.

Overview

Why Trademark Monitoring Matters

The Trade Marks Registry publishes accepted applications in the Trade Marks Journal every week. Under the Trade Marks Act, 1999, any person can oppose an advertised mark within four months of its advertisement. After that window closes, the only remedy against a registered conflicting mark is a rectification or cancellation proceeding, which is slower and more costly.

The Registry’s own examination does not always catch every similar mark, especially across related classes, in different scripts, or with small spelling changes. Monitoring fills this gap by checking the Journal and new filings against your marks on a regular basis.

Monitoring also helps you spot infringers using your brand online or in the market, so that a notice or other action can be taken early.

Basis: Trade Marks Act, 1999 (sections 20, 21 and 47–57); Trade Marks Rules, 2017; IP India Trade Marks Journal. Last updated: 27 September 2026.
