A logo should look good and also be protectable. Expertvuw’s design team creates original logo concepts, checks them against existing marks before you finalise, and hands over files and ownership documents so you can register the logo as a trademark and copyright.
A logo is often the most visible part of a brand, and it is protected in two ways in India: as a trademark under the Trade Marks Act, 1999 (protecting its use as a brand for goods or services) and as an artistic work under the Copyright Act, 1957 (protecting the artwork itself).
Many logos run into trouble at the trademark stage because they are too similar to existing marks, use generic symbols common in the industry, or rely on descriptive words. Checking designs against existing marks before finalising — and keeping the design distinctive — reduces the risk of objections and disputes later.
Ownership also matters. When a logo is created by a designer or agency, the copyright stays with the creator unless it is assigned in writing. A clear assignment ensures your business owns the artwork and can register and enforce it.
Basis: Trade Marks Act, 1999 (distinctiveness and similarity, sections 9 and 11); Copyright Act, 1957 (artistic works, ownership and assignment, sections 17–19). Last updated: 27 September 2026.
