Insolvency and Bankruptcy Code (IBC): Process and Support

Last updated: 2 October 2026

When a company cannot pay its debts, the Insolvency and Bankruptcy Code sets out a time-bound process to resolve or liquidate it. Our team helps creditors and companies understand their position, prepare documents and work with insolvency professionals and advocates through the process.

Overview

How insolvency works under the IBC

  • A corporate insolvency resolution process (CIRP) can be started by a financial creditor, an operational creditor or the company itself before the NCLT, where the default is at least ₹1 crore.
  • Once admitted, a moratorium stops most legal actions against the company, and an insolvency professional takes over management as resolution professional.
  • Creditors file their claims, a committee of creditors is formed, and resolution plans are invited and voted on.
  • The process must be completed within 330 days, including litigation time; if no plan is approved, the company goes into liquidation.
  • For MSMEs, a pre-packaged insolvency process is available for defaults of ₹10 lakh or more, to be completed within 120 days.

The IBC (Amendment) Act, 2026 made further changes, including faster admission and new processes; some provisions are yet to be notified, so we confirm what applies to your case.

Based on the Insolvency and Bankruptcy Code, 2016 and IBBI regulations, as amended by the IBC (Amendment) Act, 2026. Last updated: 27 September 2026.
