A registered trademark gives you the exclusive right to use your brand name, logo or tagline for your goods and services across India. Expertvuw’s team runs the search, picks the right classes and prepares the TM-A application, filed through registered trademark agents.
Trademarks in India are registered under the Trade Marks Act, 1999 and the Trade Marks Rules, 2017 by the Registrar of Trade Marks (IP India). A mark can be a word, logo, slogan, shape, colour combination or sound that distinguishes your goods or services. Applications are filed in Form TM-A for one or more of the 45 classes of goods and services.
The official e-filing fee is ₹4,500 per class for individuals, startups and small enterprises, and ₹9,000 per class for others. After filing, the application is examined; if the examiner raises objections, a reply must be filed within one month. Accepted marks are advertised in the Trade Marks Journal, and anyone can oppose within four months. If there is no opposition, or it fails, the mark is registered.
Registration lasts ten years from the application date and can be renewed indefinitely. You can use the ™ symbol once you apply, and ® only after registration.
