Finding the right section for your business need

What this section covers

This index brings together every service area in one place. The sections are grouped by the law or regulator involved, because that usually decides which forms, approvals and professionals a matter needs. Company law and secretarial work falls under the Companies Act, 2013 and the Ministry of Corporate Affairs; tax work under the Income-tax Act and GST laws; NBFC, payments and foreign exchange work under the RBI Act, 1934 and FEMA, 1999; capital markets and stock broking under SEBI regulations; insurance intermediaries under IRDAI; and GIFT City entities under the International Financial Services Centres Authority.

Other sections deal with a type of task rather than a regulator: registrations and licences, contracts and documents, legal notices, intellectual property, ISO certifications, digital signatures, and changes of business structure. There are also sections for fundraising, business finance, digital marketing, NGOs, ESG and competition law, NRI and cross-border matters, personal documents, and general business advisory.

Each section page explains its subject in plain terms and links to individual service pages. Approvals are decided by the relevant authority, and certification, audit or representation is carried out by independent practising professionals where the law requires. Expertvuw assists with documentation and coordination.

Frequently asked questions

Which registrations does a new private limited company need?

Incorporation under the Companies Act, 2013 gives the company its PAN and TAN through the SPICe+ form. After that, the need for other registrations depends on the business: GST registration if turnover crosses the threshold or for certain activities, shops and establishments registration under State law, Udyam registration for MSME benefits, and PF or ESI once employee numbers reach the applicable limits. Sector licences are separate.

What is the difference between an ROC filing and an income tax filing?

ROC filings are made to the Registrar of Companies on the MCA portal under the Companies Act, 2013, for example annual financial statements and the annual return. Income tax filings are made to the Income Tax Department under the Income-tax Act and report taxable income. Both are required for a company every year and have separate due dates and penalties for delay.

When does a business need RBI approval rather than just registration?

RBI authorisation is generally needed when a business carries on regulated financial activity, such as lending as a principal business (Section 45-IA of the RBI Act, 1934 for NBFCs) or operating a payment system under the Payment and Settlement Systems Act, 2007. Foreign investment transactions are reported under FEMA, 1999 rules. The activity, not the company’s name, decides which approval applies.

Which parts of a matter need a licensed professional?

Different laws reserve certain work for particular professionals. For example, secretarial audit is certified by a practising company secretary, statutory audit by a chartered accountant, and court representation by an advocate. Many other tasks, such as preparing documents or coordinating filings, can be supported by advisory firms. It helps to confirm at the start which parts of a matter require a licensed professional’s certification.
