Trademark Objection Reply – Responding to the Examination Report Within One Month

Last updated: 2 October 2026

If the Trade Marks Registry raises an objection in the examination report, a well-reasoned reply filed on time is often what decides whether your mark proceeds. Expertvuw’s team analyses the objection and prepares the reply and evidence, filed and argued through registered trademark agents or advocates.

Overview

How Trademark Objections Work

After a trademark application is filed, the Registry examines it and issues an examination report. Objections usually fall under section 9 of the Trade Marks Act, 1999 (absolute grounds — for example, the mark is descriptive, generic or lacks distinctiveness) or section 11 (relative grounds — a similar or identical mark already exists for similar goods or services). Formal issues, such as an unclear description or missing documents, can also be raised.

Under the Trade Marks Rules, 2017, the applicant must reply within one month of receiving the examination report; otherwise the application may be treated as abandoned. If the examiner is not satisfied with the written reply, a show cause hearing is scheduled, where the case is argued before the officer.

A strong reply addresses each ground specifically, distinguishes the cited marks, and where helpful attaches evidence of use, sales and reputation through an affidavit.

Basis: Trade Marks Act, 1999 (sections 9 and 11); Trade Marks Rules, 2017 (Rule 33 – examination report and reply). Last updated: 27 September 2026.
