A clear will and up-to-date nominations make it far easier for your family to inherit property, shares, bank balances and business interests. Expertvuw’s team helps you map your assets and prepare a will and supporting documents, with legal review and execution support from independent advocates.
If a person dies without a will (intestate), their assets pass under the applicable personal succession law — for example, the Hindu Succession Act, 1956 for Hindus, Sikhs, Jains and Buddhists, or the Indian Succession Act, 1925 for Christians and Parsis — which may not match their wishes and can lead to disputes. A will lets you decide who receives what, name an executor and plan for minors.
Under the Indian Succession Act, a will must be in writing, signed by the testator, and attested by at least two witnesses. Registration is optional under the Registration Act, 1908, but adds evidentiary value. Muslims are generally governed by Muslim personal law, which limits bequests by will.
Nominations on bank accounts, demat accounts, mutual funds and insurance make transfers easier, but a nominee may hold assets on behalf of legal heirs depending on the law and asset type — so nominations and the will should be aligned. Business owners also need share transfer and management continuity plans.
Basis: Indian Succession Act, 1925 (section 63 – execution of wills); Hindu Succession Act, 1956; Registration Act, 1908 (section 18); Companies Act, 2013 and SEBI/depository rules on nomination. Last updated: 27 September 2026.
