A well-drafted legal notice often resolves a dispute without going to court, and in some cases it is a legal pre-condition to filing. Expertvuw’s team helps you choose the right type of notice and prepares the facts and documents; the notice is issued by an independent advocate.
A legal notice is a formal written communication setting out a grievance, the facts, the legal basis and the remedy demanded, with a time limit to comply. For businesses, common uses include recovering unpaid invoices, breach of contract, trademark or copyright infringement, employee misconduct or exit issues, and consumer or vendor disputes.
Some notices are mandatory before legal action. A demand notice under section 138 of the Negotiable Instruments Act must be sent within 30 days of a cheque dishonour memo. A demand notice under section 8 of the Insolvency and Bankruptcy Code precedes an operational creditor’s insolvency application. Section 80 of the Code of Civil Procedure requires notice before suing the government, and many arbitration clauses require a notice invoking arbitration.
Choosing the right notice, stating facts accurately and attaching supporting documents matters, because the notice and any reply often become part of the court or tribunal record.
Basis: Negotiable Instruments Act, 1881 (section 138); Insolvency and Bankruptcy Code, 2016 (section 8); Code of Civil Procedure, 1908 (section 80); Arbitration and Conciliation Act, 1996 (section 21); Advocates Act, 1961. Last updated: 27 September 2026.
