Patent Search – Patentability, Freedom-to-Operate and Prior-Art Searches

Last updated: 2 October 2026

Before you spend on drafting a patent — or launch a product that might infringe one — a structured search tells you where you stand. Expertvuw’s team coordinates patentability, freedom-to-operate and state-of-the-art searches with independent registered patent agents and searchers.

Overview

Which Patent Search You Need

Under the Patents Act, 1970, an invention must be new (not disclosed anywhere in the world before the filing date), involve an inventive step (not obvious to a skilled person) and be capable of industrial application. A patentability search looks for prior art — earlier patents, applications and publications — to assess these tests before filing.

A freedom-to-operate (FTO) search asks a different question: whether making or selling your product in a particular country may infringe someone else’s in-force patent. A state-of-the-art search maps existing technology in a field to guide R&D, and an invalidity search looks for prior art to challenge a granted patent.

Searches use patent databases such as IP India’s, WIPO PATENTSCOPE and others, together with non-patent literature. The result is a report with the closest references and an opinion on their relevance, prepared by registered patent professionals.

Basis: Patents Act, 1970 (sections 2(1)(j), 2(1)(ja), 3 and 4); public patent databases including IP India and WIPO PATENTSCOPE. Last updated: 27 September 2026.
