Patent Filing in India – Provisional and Complete Specifications under the 2024 Rules

Last updated: 2 October 2026

A patent gives you exclusive rights over an invention for 20 years. Expertvuw’s team coordinates the process — invention disclosure, searches, fee planning and deadlines — with drafting and prosecution handled by independent registered patent agents.

Overview

How Patent Filing Works

Patents in India are granted under the Patents Act, 1970 for inventions that are new, involve an inventive step and are capable of industrial application, and do not fall under excluded categories. Protection lasts 20 years from the filing date, subject to annual renewal fees.

An applicant can first file a provisional specification to secure a filing date, and must file the complete specification within 12 months. The Patents (Amendment) Rules, 2024 (in force from 15 March 2024) reduced the time to request examination to 31 months from the priority or filing date, made the statement of working (Form 27) due once every three financial years, introduced a certificate of inventorship and a grace period for late renewal. Startups, small entities, natural persons and educational institutions pay much lower official fees, and eligible applicants — including DPIIT-recognised startups and female applicants — can request expedited examination.

Patent specifications require careful technical and legal drafting; claims define the protection you get.

Basis: Patents Act, 1970; Patents Rules, 2003 as amended by the Patents (Amendment) Rules, 2024; IP India fee schedule. Last updated: 27 September 2026.
