Home / IP & Legal / Copyright Registration

Copyright exists from the moment a work is created, but registration gives you a public record and strong evidence of ownership. Expertvuw’s team prepares the application, statement of particulars and supporting documents for filing with the Copyright Office.
Under the Copyright Act, 1957, copyright arises automatically when an original work is created — registration is optional. However, an entry in the Register of Copyrights is treated as prima facie evidence of the particulars entered, which is valuable in disputes, licensing, investment and enforcement against infringers.
Applications are filed online on the Copyright Office portal in Form XIV with a statement of particulars. Once a diary number is issued, there is a mandatory 30-day waiting period for any objections. The application is then examined; if the examiner raises a discrepancy, it must be answered, and a hearing may be held. On acceptance, the extract of the Register is issued. Fees depend on the type of work — for example, a literary or artistic work (including software) is lower than a sound recording or film.
Where a logo is used as a brand, copyright registration of the artwork complements — but does not replace — trademark registration.
