Home / Legal Notices / Cease and Desist Notice

Last updated: 2 October 2026
A cease and desist notice demands that someone immediately stop a harmful activity — spreading false statements about your business, misusing confidential information, poaching in breach of contract, or copying your work. Expertvuw’s team organises the evidence and coordinates the notice through independent advocates.
A cease and desist notice is a formal demand to stop a specific activity and not repeat it, often with a request for written undertakings, removal of content, return of material or compensation. It is used for situations such as defamatory posts or reviews, former employees or partners misusing confidential information, breach of non-solicitation or exclusivity terms, unauthorised use of IP, and unfair trade practices.
The legal basis depends on the conduct: defamation under civil law and the Bharatiya Nyaya Sanhita, 2023; breach of contract under the Indian Contract Act, 1872; breach of confidence under equitable principles; and infringement under IP laws. For online content, platforms have grievance and takedown processes under the IT Rules, 2021, which can run in parallel.
The notice should be factual and measured. Overstated threats can backfire, and notices themselves may be shared publicly. If the conduct continues, the next step may be a suit seeking an injunction and damages.
Basis: Indian Contract Act, 1872; Bharatiya Nyaya Sanhita, 2023 (defamation); Specific Relief Act, 1963 (injunctions); Trade Marks Act, 1999 and Copyright Act, 1957; IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Last updated: 27 September 2026.
