Last updated: 2 October 2026
A will only works if it is clearly written and properly executed. Expertvuw’s team drafts will deeds with precise asset descriptions and bequests, guides execution with witnesses and optional registration, and explains codicils and probate — with legal review by independent advocates.
Under the Indian Succession Act, 1925, any person of sound mind who is not a minor can make a will. The will must be in writing, signed (or marked) by the testator, and attested by at least two witnesses who have seen the testator sign. Witnesses should ideally not be beneficiaries. Registration under the Registration Act, 1908 is optional, but it provides strong evidence of execution and safe custody.
A well-drafted will identifies the testator, revokes earlier wills, describes assets clearly (property, bank and demat accounts, shares, business interests, digital assets), names beneficiaries and what each receives, appoints an executor, provides for guardians of minor children, and states what happens to any residue.
Changes can be made by a codicil, executed with the same formalities, or by making a new will. In some cases — for example, wills relating to immovable property in certain cities — probate may be required before the executor can act; in other cases, institutions may still ask for probate or succession certificates.
Basis: Indian Succession Act, 1925 (sections 59, 63, 70 and probate provisions); Registration Act, 1908 (section 18); Hindu Succession Act, 1956. Last updated: 27 September 2026.
