Arbitration Notice under Section 21 – Starting Arbitration Under Your Contract

Last updated: 2 October 2026

If your contract has an arbitration clause, the dispute usually starts with a notice invoking arbitration. Expertvuw’s team reviews the clause, organises your claim and documents, and coordinates the section 21 notice and arbitrator appointment through independent advocates.

Overview

How Arbitration Begins

Under section 21 of the Arbitration and Conciliation Act, 1996, arbitral proceedings in respect of a dispute begin on the date the respondent receives a request for that dispute to be referred to arbitration. The notice identifies the dispute, the claims, the arbitration agreement relied on, and usually proposes an arbitrator or invokes the appointment procedure in the contract.

The date of the notice matters for limitation. Many contracts also require pre-arbitration steps — negotiation, escalation or mediation — which should be followed. If the parties cannot agree on the arbitrator under the agreed procedure, a party can apply to the High Court (domestic arbitration) or the Supreme Court (international commercial arbitration) under section 11 for appointment. Institutional arbitration rules, where chosen, set their own procedures.

Arbitration clauses should be checked for seat, venue, number of arbitrators, governing rules and any restrictions, because these affect the process and later court proceedings.

Basis: Arbitration and Conciliation Act, 1996 (sections 7, 11, 21, 29A); Limitation Act, 1963; applicable institutional arbitration rules. Last updated: 27 September 2026.
