Home / Legal Notices / Send a Legal Notice

Last updated: 2 October 2026
If someone owes you money, has breached a contract or is infringing your rights, a legal notice is often the first formal step. Expertvuw’s team organises your facts and documents; the notice is drafted, signed and issued by an independent advocate, and we help track service and responses.
A legal notice sets out who you are, the facts of the dispute, the legal basis of your claim, what you want (payment, performance, stopping an activity or compensation) and the time allowed to comply. It is usually issued on an advocate’s letterhead, signed by the advocate on your instructions.
Service is typically by registered post with acknowledgement due and speed post or courier, often with email as well, keeping proof of dispatch and delivery. Some notices have strict timelines — for example, a cheque bounce notice under section 138 of the Negotiable Instruments Act must be sent within 30 days of receiving the bank’s dishonour memo — and some legal proceedings require prior notice.
The content should be accurate and measured. Overstated claims, threats or defamatory statements can be used against you later. The notice, any reply and the proof of service often become part of the record if the matter goes to court, arbitration or a consumer commission.
Basis: Advocates Act, 1961; Negotiable Instruments Act, 1881 (section 138); Code of Civil Procedure, 1908 (section 80); Arbitration and Conciliation Act, 1996 (section 21); Bharatiya Sakshya Adhiniyam, 2023 (evidence of service). Last updated: 27 September 2026.
