Last updated: 2 October 2026
Becoming a stock broker means membership of a recognised stock exchange and registration with SEBI. SEBI replaced the 1992 regulations with new Stock Brokers Regulations in January 2026. Expertvuw’s team helps applicants with entity set-up, membership documentation, the SEBI application and the compliance framework.
Stock brokers are regulated by the SEBI (Stock Brokers) Regulations, 2026, notified in January 2026, which replaced the regulations in place since 1992. A stock broker must be a member of a recognised stock exchange; the application is made through the exchange, which forwards it to SEBI with its recommendation.
Applicants must satisfy the fit and proper criteria, have adequate infrastructure and qualified staff with NISM certification, appoint a compliance officer and a designated director resident in India, and meet the net worth and deposit requirements set by SEBI and the exchange for the chosen membership type — trading member, self-clearing member or clearing member.
The 2026 regulations also allow stock brokers to undertake certain related activities, such as incidental investment advice and activities regulated by other financial regulators, subject to conditions. Brokers then face ongoing obligations on client funds and securities, cybersecurity, reporting and audits.
