NCLT and NCLAT Matters under the Companies Act and IBC

Last updated: 2 October 2026

The National Company Law Tribunal (NCLT) hears company law and insolvency matters, and the NCLAT hears appeals. Our team prepares the company-law groundwork — records, filings and documents — and works with advocates and authorised professionals who represent you before the tribunal.

Overview

What the NCLT and NCLAT decide

The NCLT hears matters such as:

  • Oppression and mismanagement petitions by members (sections 241–242).
  • Mergers, demergers and schemes of arrangement (sections 230–232).
  • Rectification of the register of members, and restoration of struck-off companies.
  • Compounding of offences above the Regional Director’s limit.
  • Insolvency and liquidation under the Insolvency and Bankruptcy Code.

Appeals from NCLT orders go to the NCLAT:

  • Under the Companies Act — within 45 days, extendable by up to 45 more days for sufficient cause.
  • Under the IBC — within 30 days, extendable by up to 15 days.

Under section 432, a party may appear in person or through a chartered accountant, company secretary or cost accountant in practice, a legal practitioner or other authorised person.

Based on the Companies Act, 2013, the Insolvency and Bankruptcy Code, 2016 and the NCLT and NCLAT Rules. Last updated: 27 September 2026.
